Operations and Contracts

Introduction

This chapter explains and explores the relations between the key actors during the operational phase and how they manage them with contracts. The key actors identified in Chapter 4 (e.g. terminal owners, terminal operators, infrastructure owners and regulators, service operators) will be examined in terms of their different priorities and their relative positions of power and influence that constitute the institutional setting during the operational phase of the terminal’s life cycle. Terminal developers in phase one, and those involved in setting the concession agreement in phase two, should anticipate such complex relationships likely to obtain during the operational phase of the terminal, as these will determine how successful the terminal is at securing the traffic for which the terminal was built.

Empirical examples of operational contracts specifying such issues are provided and explained, in conjunction with case studies performed by the authors. The question to be considered in this chapter is how does the public sector incentivise private operators to do what it wants (i.e. modal shift) when it is limited in the direct actions it can take? The chapter concludes with an institutional framework of the key actors during this phase of the life cycle, and a discussion of how it compares with the previous phases and how the terminal governance changes when moving from the planning to the operational phase.
